LEGAL PROBLEMS OF ENVIRONMENTAL EXPERTISE IN THE JUDICIAL PROCESS OF THE REPUBLIC OF KAZAKHSTAN

The article examines the issues of legal support for environmental expertise within the judicial system of the Republic of Kazakhstan. The aim of the study is to conduct a comprehensive analysis of the legal mechanisms governing the use of environmental expertise in judicial proceedings and to develop proposals for improving its legal regulation. The study identifies key problems within the current legal framework of environmental expertise and analyzes their impact on judicial practice. Among the main challenges are the fragmentation and inconsistency of regulatory legal acts, the insufficiently defined professional status and liability of experts, the ambiguity of procedural rules, and the institutional weakness of the independent expert institution. The scientific novelty of the research lies in developing a conceptual approach to improving the legal regulation of judicial environmental expertise based on a comparative legal analysis of international practices and the national regulatory model. The research employs system-structural, comparative legal, and empirical methods, enabling a comparative assessment of foreign experience and Kazakhstan’s judicial practice. As a result, several practical recommendations are proposed, including the systematization of the regulatory framework, clarification of the legal status of experts, improvement of professional certification and accreditation mechanisms, the introduction of unified methodological standards for conducting expert examinations, and the digitalization of expert procedures. The implementation of these measures will contribute to more effective resolution of environmental disputes, strengthening environmental safety, and improving the quality of justice.
