At the same time, the author focuses on the approach of European countries, since their experience in the field of data protection, ensuring confidentiality and preventing unreasonable interference in private life is considered advanced in the world. The article also touches on the issue and provides a different scientific approach regarding the relationship between the concepts of «privacy» and «personal data protection». In addition, attention is paid to the practice of the European Court of Human Rights (ECtHR), on the basis of which criteria have been developed for the lawful restriction of rights to personal data. The purpose of this work is to study advanced foreign experience in the protection of personal data to determine the feasibility and possibility of its implementation in the Republic of Kazakhstan.
