Цель научной статьи анализ современного состояния профилактики и регулирования конфликта интересов как превентивного средства предотвращения нарушений этики государственной службы и взяточничества. В статье использовались методы диалектики, формально-логический, сравнительно-правовой и метод наблюдения. В частности, методом диалектики изучены закономерности развития поступления и пребывания в государственной службе, формально-логический методом проведен анализ законодательных норм, с помощью сравнительно-правового метода проведены сравнения с законодательством зарубежных стран, также с помощью наблюдения исследован опыт разрешения конфликта интересов. В результате исследования установлено, что в казахстанском законодательстве имеются только первичные нормы предупреждения конфликта интересов на государственной службе и не сформирован полный механизм конфликта интересов в государственном секторе. В заключении на основе анализа зарубежного опыта доказана эффективность регулирования конфликта интересов на государственной службе и предложено принять закон «О конфликте интересов». Новизна статьи заключается в том, что системным подходом проведен критический анализ законодательства и правоприменительной практики предупреждения конфликта интересов на государственной службе.

The purpose of the scientific article is to analyze the current state of prevention and regulation of conflicts of interest as a preventive means of preventing violations of public service ethics and bribery. The article uses the methods of dialectics, formal logic, comparative law and the method of observation. In particular, the patterns of the development of admission and working in public service were studied using the dialectical method, the analysis of legislative norms was carried out using the formal logical method, comparisons with the legislation of foreign countries were carried out using the comparative legal method, and the experience of conflict of interest resolution was also studied using observation. As a result of the study, it was found that in the Kazakh legislation there are only primary norms for preventing conflicts of interest in the civil service and a complete mechanism for conflict of interest in the public sector has not been formed. In conclusion, based on the analysis of foreign experience, the effectiveness of conflict of interest regulation in the civil service has been proved and it is proposed to adopt the law «On Conflict of Interests». The novelty of the article lies in the fact that a systematic approach has been used to critically analyze legislation and law enforcement practice in preventing conflicts of interest in the civil service.
