В статье рассматривается вопрос о необходимости принятия специального закона о частной детективной деятельности в Республике Казахстан. Актуальность темы обусловлена существующим нормативным вакуумом: в Казахстане до сих пор отсутствует закон, регулирующий сферу частного сыска, несмотря на то, что де-факто детективные услуги оказываются. Приводятся аргументы «за» и «против» законодательного регулирования частной детективной деятельности, анализируется зарубежный опыт, а также возможное влияние легализации частного сыска на права человека и уголовное судопроизводство. В исследовании использованы сравнительно-правовой, формально-юридический и аналитический методы; проанализированы международные научные публикации, отечественные нормативные акты и проекты закона. По результатам исследования автор приходит к выводу, что принятие закона о частной детективной деятельности является целесообразным шагом для ликвидации правового пробела и обеспечения гарантий прав граждан, однако требует учета возможных рисков и включения в закон необходимых защитных механизмов.

The article examines the necessity of adopting a special law on private detective activity in the Republic of Kazakhstan. The relevance of the topic is due to the existing regulatory vacuum: Kazakhstan still lacks a law governing the field of private investigations, despite the fact that detective services are provided de facto. The article presents arguments both in favor of and against legislative regulation of private detective activity, analyzes foreign experience, and explores the potential impact of legalizing private investigations on human rights and criminal proceedings. The study employs comparative-legal, formal-legal, and analytical methods; it analyzes international academic publications, national regulatory acts, and draft legislation. Based on the results, the author concludes that the adoption of a law on private detective activity is a necessary step to eliminate the legal gap and ensure the protection of citizens' rights. However, it also requires careful consideration of potential risks and the inclusion of appropriate safeguards in the legislation.
